A French court found Cardinal Philippe Barbarin, archbishop of Lyon, guilty on March 7 of failing to report abuse to the authorities, and imposed a six-month suspended sentence.

Cardinal Barbarin said in a statement that the pope had acted “invoking the presumption of innocence.”

If a convicted Cardinal Barbarin says the Pope is invoking "presumption of innocence" in not accepting his resignation, then I would ask: Is the Pope above French law?

The conviction against Cardinal Barbarin is about his failing to report accusations of Rev Bernard Preynat molesting dozens of boys. Reporting these accusations is mandatory under French law.

Fr Preynat admitted some abuse in correspondence to victims' families. Preynat was removed from his post in 2015 by Barbarin. Fr Preynat is awaiting trial on charges of sexual abuse of minors.

Mr Preynat lawyer's has said his client has admitted the abuse, but that the statute of limitations precludes prosecution. Officials argue that some offences can still be prosecuted and a criminal case has been opened against the priest.

Cardinal George Pell and other senior officials failed to exercise proper care for children in a Melbourne parish by not acting on information of sexual misconduct by a paedophile priest, according to final submissions to the royal commission into child abuse.

In her submissions to the Royal Commission into Institutional Responses to Child Abuse, Counsel Assisting Gail Furness SC also stated she believed the evidence of a number of witnesses in the Ballarat and Melbourne dioceses instead of Cardinal Pell's in relation to the Cardinal being told by children and adults of inappropriate clerical conduct towards children in the 1970s and 1980s.

Counsel Assisting has found that Cardinal Pell, along with a number of other priestly consultors to Bishop Ronald Mulkearns of the Ballarat diocese, knew notorious serial paedophile priest Gerald Ridsdale was being moved from parish to parish because he was sexually abusing children, despite the Cardinal's strong denials.

Allegations about Ridsdale's behaviour were never sent to police.

The consultors meeting, where the submission says Cardinal Pell should have known, took place at the same time as some of the worst offending was committed by Ridsdale in the parish of Mortlake.

It was estimated by the nun who was school principal that he abused 20 of the 30 boys at the school.

"It is submitted it was the common understanding of the [1982] meeting that complaints that Ridsdale had sexually abused children was the reason it became necessary to move him," she [FURNESS] said in the submission.

After the intervention of Information Commissioner correspondence between Bon Secours and Minister for Children Katherine Zappone was released to Right to Know journo Ken Foxe :


Right to Know journalist Ken Foxe published a “strictly private and confidential” letter sent from the leader of the Bon Secours in Ireland Sr Marie Ryan to the Minister of Children Youth Affairs Katherine Zappone last August.


On or about 2 August 2018, Sr Marie Ryan wrote in reply to Minister Zappone wanting Bon Secours to share "cost implications" arising over several years from the Tuam Home:


“This was an institution created and operated by the Irish state.”

“Given the passage of time, it certainly appears to us, that the Home was not only under the stewardship of the Sisters at that time but under the supervision, direction and inspection of the local authority Galway County Council and also the Department of Health.”

“The deaths of the infants were registered at that time and it would seem to us that it would follow that Galway County Council, the Department of Health and the doctor employed by the local authority for the Home would have been fully aware of the fact of these deaths and no doubt then would have been aware that burial arrangements would have to be made for the remains."


A second letter from Minister for Children Zappone explained her request for monetary support was independent of the ongoing Commission of Investigation into Mother and Baby Homes:


Minister Zappone said all parties involved in Tuam had a ~


"shared moral and ethical responsibility to ensure appropriate action is taken to compassionately respond to this tragic situation".

Minister for Children Katherine Zappone stated to Bon Secours Ireland her interest related ~


“exclusively to the future of the site and the remains interred therein”.

“As such I see this as separate and without prejudice to the ongoing investigations into the circumstances and responsibility for the disposal of human remains in this way.

“You may recall that in expressing its shock at the discovery of the infant remains, the Commission asked that the relevant parties take responsibility for the appropriate response to this discovery.”


Statement from Minister Zappone's department:


“At this juncture it would not be appropriate to pre-empt the outcome of the independent Commission’s work on this or other matters.”

"As indicated in the correspondence, Minister Zappone considers that all parties involved with the former institution have a responsibility to ensure appropriate action is taken to honour the memory and dignity of the children who died.

“The Minister’s request to the Sisters of Bon Secours related exclusively to the issue of financing such an appropriate course of action at the site of the former institution.”

George Pell was fortunate to have been sentenced on more lenient terms of imprisonment at the time of his offending…



"The judge said the court had searched for precedents for sentencing dating from the time that Pell committed the offences, but they found very few cases that could guide them.

"The sentencing principles are that you actually get sentenced for the terms of imprisonment at the time of the offending," ….

"At the time it was a possible sentence of only 10 years.

The parliament of Victoria has recognised that was too lenient and they've changed that.

"If he were to have offended now he'd face a sentence of up to 15 years."

He said this was a specific issue with sentencing in cases of child sexual abuse.

"These kinds of offences often only come out much later, after they've occurred," Mr Webb said.

He said there was an argument for changing these principles for cases involving historic child sexual abuse.

Changes to that effect were introduced in New South Wales last year.

"Ms Crowe said anonymisation and redaction “in no way detracts from the historical significance of the records”, as information is not permanently removed. “In the case of anonymisation, a database is made of the full information contained in the records, and *a copy created with certain fields with personal identifying information removed,* " ...

“…. The originals are stored elsewhere, pending their eventual reunion with their files. This process, tedious though it is, could give everyone access to the administrative files of the relevant bodies after 30 years, in accordance with the National Archives Act.”

[Separately]… in a written reply this week to Sinn Féin president Mary Lou McDonald, Ms Zappone also said the report includes burial arrangements “in circumstances where the [children’s] remains were initially transferred to educational institutions for anatomical examination”.


Ms Zappone stated:


It is a substantial report which focuses on the burial arrangements of persons who died while resident in these institutions.​
The report includes extensive technical reports prepared in the course of the Commission’s investigations into the burial site associated with the institution formerly known as the Tuam Mother and Baby Home and the Commission’s assessment of burial arrangements in respect of a number of other institutions within its remit.​
It also reports on burial arrangements in circumstances where the remains were initially transferred to educational institutions for anatomical examination.
I intend to seek formal Government approval to publish the report after I have the opportunity to discuss the report with the Commission and consult the Attorney General as appropriate. I will seek to conclude these considerations as soon as possible.​
The dignity and memory of those who died in these institutions is central to my approach to these matters. I am mindful of the expectations of their families for an early publication date of the report.​
My Department will advise representative groups, and those who have been in contact with the department on these matters, of developments prior to the publication of the report.​
Given the importance and sensitivity of these matters, I do not propose to comment further on the contents of the report in advance of it being made public.​

Making a total of 118 remains of infants sent from institutions for dissection, and it wasn't confined to Dublin. 35 babies were sent to University College Galway for anatomical study during the same period."

"Heads of Irish Medical Schools provided figures, but declined to be interviewed for programme. They suggested that the bodies could have been unclaimed, as prior to the late 1960s a lot of unclaimed bodies were those of infants and as such could legally be sent for dissection. ….

"There was a shortage of bodies for dissection. Graveyards like Glasnevin had to be guarded from grave robbers.

"The Anatomy Act of 1832 was introduced to put a halt to this, in practice it legalised the dissection of the poor.

So it's significant, the 3 institutions that supplied the majority of infant remains to the colleges were St Patrick's, St Kevin's and the Central Hospital in Galway, were all former workhouses with a history of sending their pauper dead for dissection.

——> How the infants who passed away in Mother and Baby Homes could be classified as unclaimed?


Dr Ruth Richardson said the mothers were there with their children. Unless the mothers were being treated as though they were paupers and had no rights in law. She couldn't see how they could say the child was unclaimed

"Daughters of Charity of St Vincent de Paul who ran St Patrick's declined an interview, saying at this remove they had no knowledge or information on anatomical studies on the bodies of deceased infants from St Patrick's. They stressed that the sisters of St Patrick's were at all times merely employees of the relevant health authority.

"By law the medical colleges had to inform the Department of Health each time they received a body. They asked the Minister for Health and Minister for Children to take part in the programme, they declined. Neither was available. Jointly they made a statement … "The Ministers deeply regret any distress caused as a result of any out-dated practices which are no longer in place or acceptable." They said they were working on a human tissue Bill which would provide for a strong consent framework.

The National Redress Scheme for victims and survivors of institutional child sex abuse not only gives the finger to the recommendations of the Royal Commission into Institutional Responses to Child Sex Abuse, but also demeans the long term impact, suffering and the life shattering consequences, mental and physical impairment endured by victims of sexual assault in the wider community.

Moreover, these very institutions have spent millions during the decades in cover-ups and securing the silence of victims, more latterly in defending the indefensible before various enquiries, the Royal Commission and court cases.

UN Special Rapporteur Ms Maud de Boer-Buquicchio's report says:



"It has been regularly reported that adoptions were made against the wishes of the natural mothers, or through the deception of those mothers in order to get their consent. Birth records were also falsified."

"Meanwhile those affected are advancing in age, so the need for a comprehensive national examination of forced and illegal adoptions is urgent. Failure to provide information, redress and justice for these human rights abuses perpetuates the harm to the victims."


Report's recommendations include that Ireland conducts:
(y) a “comprehensive national examination of forced and illegal adoptions, including audits of records in the hands of the State, while ensuring that individuals whose birth records were falsified have access to information and redress;"​
(y) a "full investigation into the human rights violations and abuses connected with Magdalene laundries"​

While everyone is waiting for the Mother and Baby Homes Report, people have completely forgotten about the scoping exercise into illegal registrations. Due in Oct it has been delayed twice and in my view could force a State inquiry into adoption practices

There should have been state and public inquiries long ago into the practices in these homes and on the Magdalene Laundry institutions.

Every response in these areas from successive Irish Governments could easily be read as rearguard actions delaying disclosure.

I suspect it is a deliberately managed process (a) to slice and dice the news over a long period in the hope that it will fade gradually into the news background (b) to manage eventual state liability (as we know another less than endearing habit in a state with a Criminal Assets Bureau our state has a remarkable fondness for indemnifying religious organisations with taxpayers money and is singularly poor among governments in its ability to ensure repayment of public funds).

Melbourne Rally calls for changes to National Redress scheme




Lawyer and victims' advocate Judy Courtin, who organised the rally, said the scheme was "appalling" and it re-traumatised victims.

She said all recommendations of the royal commission into child sexual abuse in Australian institutions should be implemented, and the cap on redress payments increased to $400,000.

Opposition [Labor] leader Bill Shorten told reporters on Sunday he was open to improving the scheme, if elected.

The federal government on Friday called on institutions where abuse has occurred to join the scheme.

The Proceeds of Crime Act, 1996 was an Act of the Oireachtas in the Republic of Ireland. It deals with the disposal of any property or assets that have been obtained through criminal means.[1] It was designed to deal with organised crime and coincided with the establishment of the Criminal Assets Bureau.[2]

In August 1996, a new specialist agency, called the Criminal Assets Bureau (hereinafter “the Bureau”) was established in Ireland. It was established by the Criminal Assets Bureau Act 1996 (the “CAB Act”). This legislation was part of a series of legislative initiatives enacted over the summer of 1996 in response to increasing public concern about the level of organised crime in Ireland and the murder of one of the country’s top crime investigative journalists, Veronica Guerin. …. The functions of the Bureau are set out in section 4 of the Act: first, identification of the assets wherever situated, of persons which derive or are suspected to derive, directly or indirectly from criminal activity; secondly, the taking of appropriate action under the law to deprive or to deny to those persons of the benefit of such assets, in whole or in part as may be appropriate; thirdly, the pursuit of any investigation or the doing of any other preparatory work in relation to any proceedings arising from these two objectives.

Brings to mind what we witnessed with institutional child abuse.


Andrew49 explained that the Ryan Report published in May 2009 was the #2 report that Judge Sean Ryan SC published.


Ryan's lesser known #1 Report was published seven years before the Commission to Inquire into Child Abuse, 2009 Report.


#1 Report of 2002 is titled: Towards Redress and Recovery. It spelled out the sums of money certain categories of abuse / injuries / damage would attract.

Ryan acknowledges that abuse had taken place here (p77):


It is unquestionably true that no amount of money can "compensate" for a body which has been battered and a mind which has been shattered; but the award of appropriate financial redress can at least provide some tangible recognition of the seriousness of the hurt and injury which has been caused to the victims of institutional child abuse.

When Ryan took over from Judge Mary Laffoy, he stated that his purpose was to investigate whether any abuse had taken place!!!

And this ^^^ despite all of Judge Mary Laffoy's work ... outlining child abuse, and spelling out Church and State culpability in her reports!!!

Ryan had met victims / survivors before he took over the Commission to Inquire into Child Abuse and heard their testimonies.

Andrew49 said Justice Ryan was compromised from the beginning, but he never acknowledged it.

Andrew also believed the Bertie Ahern Government only wanted a confidential forum where survivors could tell some of their stories and get a small pay-out (walk-in, walk-out)The majority of survivors wanted investigations into their testimonies, to be able to face their abusers, to question their abusers and to have testimony of the abusers challenged. Survivors wanted the right to pursue and discover documents held by the religious orders (Ireland) in Rome.

Andrew stated two of the Orders ~ Christian Brothers and the Rosminians ~ held files in eleven rooms at the Vatican. Both Orders quoted from these documents during sittings of the Commission, but none of these documents were actually _ discovered_ to allow survivors to peruse them.

He said the Ryan Commission should have demanded the documents and not allowed selective quotes. Andrew believed Justice Mary Laffoy would have done this, as she had made the same demands on the Department of Education. We know what happened there (Laffoy resigned in 2003).

Andrew49 said most of the survivor witness testimony to the Commission came from people locked up between 1940 up to1970… But only 10 percent of documents concerning those survivors (1940-1970) came to light from the Department of Education.

A former caretaker ~ Pat Finnegan ~ of Bessborough Mother and Baby Home recalls how bodies of babies 'wrapped in a sheet' were passed out of window for night-time burials away from the graveyard

Sacred Hearts of Jesus and Mary Bessborough Mother and Baby Home had a high infant mortality rate

It's feared 600 babies lie in unmarked graves at the institution in Cork





Pat Finnegan, who worked as a caretaker at Bessborough in Cork until retirement in 1991, is backing survivors who want the grounds excavated.

His shock disclosure comes as campaigners claim a newly-uncovered map with a large area marked “Children’s Burial Ground” warrants a major site exploration.

Pat, who has given his testimony to the Commission of Investigation, also revealed three women who spent their entire lives there were not given a proper burial. ….

“The nuns have a huge plot up in St Joseph’s Cemetery and these three old ladies were buried up there between the path and the wall." "…. they haven’t even got a headstone between them."

THE SACRED HEARTS ORDER HANDED OVER THE DEATH REGISTER FOR BESSBORO' TO HSE IN 2011:


*In the case of Bessborough, the death register shows that 470 infants and 10 women died in Bessborough between 1934 and 1953*


A total of 273 deaths took place in just a six-year period between 1939 and 1944. However, the Order reported 353 deaths to State inspectors in this period.

Running to more than 50 pages, it lists each child’s name, date of death, former residence of the deceased, gender, age at last birthday, profession (which is marked ‘son’ or ’daughter’ in most cases), cause of death, duration of illness, initials of the officer recording the death, and the date when the death was registered.
