This case is being held in the Massachusetts Supreme Court tomorrow. If they throw out the concept of "Repressed Memory" (RM) it will be the beginning of the end for that voodoo brain science in the USA - just like an FBI report in 1992 was the beginning of the end for Satanic Ritual Abuse (SRA).

We never had any SRA in Ireland and I think Nora Wall was the only person convicted on RM evidence.

Prosecutors originally charged Shanley with sexually abusing four men when they were children in Newton during the 1980s. They later dropped three of the men from the case. All four men said they recovered memories of the abuse years later. .........

Shanley was convicted of child rape and indecent assault and battery [of one of the four]. He is now serving a 12- to 15-year prison sentence.

A judge last year rejected Shanley's request for a new trial, finding that the theory of repressed-recovered memories, though controversial, is "generally accepted by the relevant scientific community of mental health professionals."

Shanley's lawyer appealed, and the state Supreme Judicial Court agreed to take the case. .........

Dr. Harrison Pope, a psychiatry professor at Harvard Medical School and one of the leading critics of the theory, said he believes testimony about repressed-recovered memories should not be allowed in courtrooms.

"If you are going to present scientific opinions to a jury of non-scientists, it has to be science that is well-documented, where the scientific community agrees on it. You can't use so-called junk science in front of a jury," said Pope, one of the experts who signed a friend-of-the-court brief.

"Repressed Memory" is not accepted by the Irish courts presently. Nor will it, one imagines. Repressed memory was only one part of the Wall conviction and the Court of Criminal Appeal were none too impressed with it, as it had not been revealed to the defence that the "memory" of the incident was one retrieved in that way.

The Judgement of the Court of Criminal Appeal on D.P.P. v Nora Wall on 16 December 2005 is at

"It is now also accepted by the respondent that there had been significant non-disclosure in this case, including (a) the information that Regina Walsh had made, but not pursued, an allegation of being raped in England and (b) the non-disclosure of Regina Walsh’s very proximate and material psychiatric history. It seems to this court that the applicant was further prejudiced during the course of her trial by evidence of which the defence had no prior notification, namely, that Regina Walsh recalled the alleged episodes of rape by reference to ‘flashbacks and/or retrieved memory’. There was no scientific evidence of any sort adduced to explain the phenomenon of ‘flashbacks’ and/or ‘retrieved memory’, nor was the applicant in any position to meet such a case in the absence of prior notification thereof."

The Boston Globe and Repressed Memory

From the Boston Globe today. The Boston Globe was one of the chief instigators of the witch-hunt against former priest Paul Shanley from 2002 until his conviction in 2005. Incidentally before the "Repressed Memory" witch-hunt there was a Satanic Ritual Abuse one and the State of Massachusetts was at the centre of that as well.

It is hardly a co-incidence that the original Salem Witch-hunt also took place in Massachusetts! Little has changed since 1692.

However, another large group, the Leadership Council, which consists of lawyers, academics, and scientists, has filed a brief saying repressed memory is a legitimate phenomenon. ...........

The victim accused Shanley of pulling him out of Sunday school at St. Jean’s Church in Newton when he was between 6 and 11 years old and molesting him in the pews, rectory, confessional, and boys’ room. The former altar boy testified he did not remember the abuse until 2002, when he learned about a Globe article outlining accusations against Shanley by other men, including a former Sunday school classmate. Three other accusers were part of the initial case but were dropped as it went to trial.

All the more reason why children should be well educated about the dangers of abuse, the abusers should be identified as soon as possible, and not protected by any organisation they happen to belong to.

I don't know much about "repressed memories" or how legitimate a practice it is. My hope would be never to see anyone convicted on flimsy or dubious evidence or testimony, but that justice be served as rigourously as possible.

Has anyone been convicted for what was done to Nora Wall? I am referring not just to the so-called victims but also to the people responsible for with-holding relevant information from Nora Wall's lawyers. Was that information also withheld from the court which first tried Nora Wall? If so, heads should roll.

The wall case is a bad example as the DPP really messed up that case .

It was withheld Glenn. See above the comments above of the Court of Criminal Appeal. The fact that the witness was getting counseling was not withheld merely the fact that the "memories" of the event were of a "repressed" nature.

The prosecutor in the Paul Shanley case was also heavily involved in one of the Ritual Abuse/Day Care Centre cases in the 1980s - also in Massachusetts (of course). I am reasonaby hopeful that the Massachusetts Supreme Court will - finally - rule against Repressed Memory but in the long run I am not hopeful at all. In Massachusetts (and California), no sooner had Satanic Ritual Abuse (SRA) fallen into disrepute than the judges started to accept the Repressed Memory variety of hysteria. If and when RM becomes too ridiculous to believe any more, they will fall for some other brand of lunacy.

Remember the allegations that the Christian Brothers murdered children in Artane and Letterfrack? These were the IRISH equivalent of SRA and RM. If RM goes down the drain in Massachusetts, I predict that the Boston Globe will start to publish similar child-killing claims about Catholic Church schools in the USA.

Repressed memory evidence is a seriously dodgy area and in my opinion not worth the paper it is written on until I see some hard evidence proving otherwise. I genuinely feel for anybody who is innocent and imprisoned for a crime and particularly this type of crime.

But lets not lose sight of the thousands of victims of abuse in this country that this technique was not used to get evidence.

A small handful of people wrongly convicted never under any circumstances makes the endemic abuse carried out in the institutions in this and other countries go away.

"Thousands" of children were definitely not victims of abuse in this country. The case of Nora Wall was not an aberation. Since her trial not a singles nun has been convicted of any crime. In fact not a single prosecution against a nun has been approved by the Director of Public Prosecutions. That is despite the fact that the media shrieked obscenities at nuns and made allegations against them up to and including the killing of children

In the book "Suffer the Little Children" published in November 1999 as a follow up to her TV series "States of Fear", Mary Raftery and her co-author Eoin O'Sullivan wrote:

"Dear Daughter concerned the experiences at Goldenbridge Industrial School, Dublin of Christine Buckley, who grew up there during the 1950s. She had suffered horrific abuse , and descriptions were also given of the systematic ill-treatment of other children by the Sisters of Mercy, who ran the school. These included memories of children being routinely and savagely beaten, having boiling water poured over them, being locked in a furnace room, being forced to stand all night in a corridor as punishment, and very young children being made to sit on potties so long that in some cases their rectums collapsed."

But not a single prosecution followed - not even for pouring boiling water on children!

After the "States of Fear" series was broadcast a journalist in the Irish Independent wrote on 9 May 1999:

"In Australia, hundreds of orphaned children were flogged, beaten and sexually abused at a Sisters of Mercy orphanage in Queensland. The regime of abuse is believed to have lasted 90 years. One child was said to have been burned with a red-hot poker to ``exorcise the devil. A nun pulled out another child's ingrown toenails with a pair of pliers. Girls were raped by priests and male workers. Some became pregnant and miscarried. It is alleged that foetuses were flushed down lavatories to cover up the crimes."

Oddly enough the Australians don't seem to have prosecuted nuns for flushing foetuses down toilets either!

These atrocity stories are the IRISH equivalent of Satanic Ritual Abuse and Recovered Memory. (The above article is entitled "Church Needs Public Exorcism Over Abuse" - so the nuns were being LITERALLY demonised) We are no better than the Americans. We just have a different brand of hysteria.

A Liberal Witch-Hunt

The conviction of former priest Paul Shanley on Repressed Memory evidence in 2005 actually revived Repressed Memory which seemed to be going the same way as Satanic Ritual Abuse. However It wasn't only anti-clerics who revived the witch-hunt. It The following is from a letter by a "liberal" NUN about the Shanley case. She provides no proof that RM is real but nonetheless wants Shanley denied another trial and kept in jail forever. Also all Statutes of Limitation should be removed where allegations of child abuse are concerned.

Sister Maureen [an Irish connection?] Paul Turlish describes herself as "an educator and member of the Delaware nonpartisan coalition Child Victims Voice. She testified before the Senate and House Judiciary Committees in support of Delaware’s 2007 Child Victims Law which removed all statutes of limitation in regard to childhood sexual abuse and provided a two year civil window for bringing forward previously time barred cases."

There is no argument in her letter - just ranting.

If life were fair, Shanley would spend the rest of his natural life incarcerated. Children, young people and vulnerable adults would never again be put in harm’s way as they were since Shanley’s 1960 ordination in the Archdiocese of Boston.

If life were fair and church officials like Cardinals Medeiros, Cushing and Law and Bishops Daily, Mulcahy and John McCormack, who knew about Shanley early on, had done what they should have done, there would be no entertaining the possibility of a new trail.

This reality is much harder to stomach and it is the reason why the citizens of all of our states should be supporting legislation that will forever remove all criminal and civil statutes of limitation regarding the sexual abuse of children.

It is unconscionable and downright immoral for churches of any denomination to be opposing the removal of statutes of limitation and fighting allegations of crimes, known to be credible, in court on the basis of arbitrary statutes.

This is tragic and it speaks to the skewed value we as a society place on children, especially those victims of childhood sexual abuse. ..........

But while we may take the moral high ground on these issues, many of us ignore the victims of childhood sexual abuse who are right in front of us and instead talk about the abuse victims who must be in it for the money along with their greedy lawyers, make inflammatory statements about the anti-catholic attitudes of anyone who would suggest accountability and the bias of just about every newspaper in the country, calling down God’s eternal wrath on them from time to time.

None of which does much to address the problem.

This is a continuing societal problem, a tragedy of unspeakable horrors which must be dealt with, but justice, like charity, has to begin at home. .....

Real accountability requires that all arbitrary statutes of limitation, criminal and civil, on the sexual abuse of our children be removed and that a window of at least two years be provided to allow previously time barred cases to be brought forward in a court of law.
Justice and charity are what Jesus taught. He never said it was contingent on the price tag. The people of all states and religious persuasions deserve better and our churches should be leading the way, not building barriers that thwart access to justice.

And Paul R. Shanley?

He should be kept in jail.

Indeed I knew it and I wonder where did Judge Ryan get his allegations from? Was it by any chance from the gentleman who gave two interviews to "Ireland on Sunday" in July/August 1999 - the first one just before the case against Nora Wall and Pablo McCabe collapsed, the second one just after. Anyway here are extracts from the two interviews.

(1) Ireland on Sunday, 25 July 1999 (extract) John Mooney and Kathy Donaghy

Since the conviction, a number of former residents of St. Michael’s child care centre in Cappoquin have come forward to state that the picture painted in court bears no resemblance to the Nora Wall they knew.

However one former resident told Ireland On Sunday that he knows of a former female resident at the centre who claims she was raped by Nora Wall.

Gerry Kelly, 42 who now lives in Cappoquin and is a founder member of the Alliance for the Healing of Institutional Abuse, said that the woman, who is now 25 years of age and in a very distressed state, came to a meeting of former residents of the centre, which was held in Dungarven on July 8.

He said Regina Walsh, the gang rape victim of Nora Wall and Pablo McCabe was also at that meeting.

He said the woman, WHO IS A CLOSE FAMILY FRIEND, [my emphasis] was raped by Wall, then Sister Dominic of the Sisters of Mercy, at least once during her time at the centre between 1982 and 1990.

He said the young woman needed help but was not yet prepared to come forward. “She is not even prepared to talk to counsellors yet “, he said.

Kelly said he would hold another meeting for residents of St. Michael’s in September.

(2) Ireland on Sunday, 1 August 1999 (extract) Eugene Masterson

Former residents were invited to a meeting in Dungarven on July 8 last TO HEAR HOW THEY COULD PROCESS COMPENSATION CLAIMS IF THEY FELT THEY WERE ABUSED THERE [My emphasis].

The meeting was organised by the self-proclaimed Alliance for the Healing of Institutional Abuse (AHIA). The founder is 42-year-old Gerry Kelly.

Kelly lives outside Dungarven and was a resident of St. Michael’s from 1969 to 1975.

While alleging he was beaten there, he also claims it was like a holiday camp compared to the infamous Artane Industrial School in Dublin where he also spent time.

Gerry Kelly says that another proposed meeting for next month may be in doubt because of the overturning of the convictions.

“That case is after knocking the thing back, there’s no justice in this country, you know yourself”, he says. … “A lot of things happened in Cappoquin that I didn’t approve of and I went to the Reverend Mother in charge and I was told to keep it to myself what I saw.

This is all a f….. stitch up as far as I’m concerned”.

Retired Garda sergeant Vincent Bergin and his wife Brid had for many years, the only house located across the road from the home. They would allow their six children to play in the home and invited kids from St. Michaels to their own house. One of the children they hosted was Regina Walsh.

Vincent Bergin described the allegations against Sister Dominic as “bloody ridiculous”. …
“Where Dominic made the mistake was that all those weirdos – although most of the people who went there were decent - she allowed them to come back and stay. She used to say: ‘That’s their home, that’s their only home’.

The woman was naive.”

MY COMMENT: We can safely assume that no one is going to be that naive again and no one is going to invite children from an institution into their home either.

I should say that the information from the two newspaper articles is available on the website of "Alliance Support". This is a group that supports genuine victims of child abuse.

This is from Breda O'Brien's article "Pablo McCabe and Nora Wall" - Studies Review, Winter 2006. Pablo McCabe is the man whom Regina Walsh claimed raped her with the assistance of Nora Wall.

"Paul McCabe addressed a Diocesan Gathering of Mercy Sisters in Gracedieu in Waterford in 1988. His account tells of being born in Dublin in 1949 to a single mother. She struggled on until Paul was three, but she ‘had great difficulty in working, paying for accommodation and paying someone to look after me.” Thus he came to live in what was to become known as the “ old St. Michael’s”, a junior industrial school run by the Sisters of Mercy in Cappoquin. His memories of that time are “very happy ones of caring and interested women.” He then went to the Industrial School at Artane, Dublin, which he found traumatic, as it had “over nine hundred boys in a very strict set-up.”

"After leaving Artane, he began to drift and became involved with drugs, including time spent in South America. He returned to Ireland in 1977. He stole to support his drugs habit. He had treatment in St. Brendan’s Hospital, and alcohol abuse remained a problem. In 1980, he came to Cappoquin again. He stated, “Cappoquin is my home. In Dublin I am homeless.” The institution where he had been reared had been closed and replaced with group homes, Coisceim and Emohruo, where he met Sr. Dominic (Nora Wall) although, as someone of roughly the same age, she had never known him in St. Michael’s. He hoped to find information about his mother, but none existed. In 1986 his mother wrote hoping to find out something about her son. Sr. Dominic facilitated a reunion, and mother and son spent three happy days together in Cappoquin."

That ties in with the article in Ireland on Sunday on 1st August 1999.

Priest's Lawyer Says Repressed Memory is Junk Science

I get the impression that the American journalists whose hysterical attacks got Shanley convicted, no longer believe in Repressed Memory (RM) themselves. However the Massacheutetts judiciary has a repulsive history in this area - first with Satanic Ritual Abuse and then with RM. I would not put it past the the judges to dodge the issue by saying that the validity of RM is a matter for the jury to decide and since Shanley's jury choose to believe it then everything is OK!

[Shanley's lawyer] Shaw said, "We are not talking about not thinking about something and later remembering it and we're not talking about somebody who has some memory distortion and then can't remember part of a experience later. We are talking about somebody who was in a concentration camp and then forgot it ever happened."

Shanley's lawyer submitted an affidavit by Harvard researcher Dr. Harrison Pope, who cited a wealth of research and argued, "adding up the more than 14,000 victims reported in more than 120 studies … it is inconceivable that 'repressed memory' could be a valid and accepted scientific theory, yet not be demonstrated in a single unequivocal case reported throughout this vast literature."

But representatives for the Leadership Council for Child Abuse and Interpersonal Violence -- another group of prominent psychiatrists and psychologists -- said that judges allow repressed-recovered memory as testimony "all the time" and that it is, indeed, an accepted phenomenon among psychiatrists.

"Even this [Massachusetts] court has already decided that it's a well-settled question," said Wendy Murphy, adjunct professor at the New England School of Law and founder and director of the Victim Advocacy and Research Group in Boston.

Although courts have allowed repressed memories, several convictions in high-profile cases have been overturned based on repressed- and recovered-memory testimony. In 1995, for instance, a federal judge overturned the 1990 conviction of George Franklin Jr.

Franklin's daughter accused him of the 1969 murder of her 8-year-old best friend 20 years after the murder, saying she had recovered a memory of her father holding a rock over her friend's head. The judge overturned the verdict after Franklin's daughter accused him of a second murder."


Clearly Franklin's daughter had some issues with her father and decided to "get her own back" in this way. Usually women like that make false allegations of child abuse. Franklin was lucky in the long run that his daughter accused him of murder since that is easier to disprove. Also there is far less hysteria about murder!!

There was no hysteria. Shanley had a very long history of allegations against him.

Shanley was accused of sexual abuse in the 1960's, the 1970's, the 1980's and the 1990's. His church personnel records indicated he was transferred from parish to parish despite allegations of abuse. The Boston Herald (4/9/02) printed that Shanley "spoke in favor of sex between men and boys at a formative 1978 meeting in Boston of the “Man Boy Lovers of North America” and that he "admitted openly to raping and sodomizing minors when confronted by church investigators under Boston’s two past archbishops, Humberto Cardinal Medeiros and Law."

There is very strong scientific evidence that recovered memories exist. This has been shown in many scientific studies. The content of recovered memories have fairly high corroboration rates.

Scientific evidence

There are many studies that have proven that the recovered memories of traumatic events exist. Brown, Scheflin and Hammond found 43 studies that showed recovered memories for traumatic events[3]. The Recovered Memory Project has collected 101 corroborated cases of recovered memories[4]. Hopper's research shows that amnesia for childhood sexual abuse is "beyond dispute." He states that "at least 10% of people sexually abused in childhood will have periods of complete amnesia for their abuse, followed by experiences of delayed recall" [5] In one study of women with previously documented histories of sexual abuse, 38% of the women did not remember the abuse that had happened 17 years before.[6] Most recovered memories either precede therapy or the use of memory recovery techniques[7]. One studied showed that five out of 19 women with histories of familial sexual abuse either forgot specific details or had "blank periods" for these memories[8]. Another study showed that "40% reported a period of forgetting some or all of the abuse"[9]. Herman and Harvey's study showed that 16% of abuse survivors had "complete amnesia followed by delayed recall"[10]. Corwin's individual case study provides evidence of the existence of recovered memories on videotape[11].

Corroboration rates
Many studies show high corroboration rates for recovered memories of traumatic events. These rates vary from 50 - 75%[14], 64%[13], 77%[15], 50%[16], 75%[17] 68%[18] 47%[9], and 70% [19]. One study showed amnesia in 12 murderers, with "objective evidence of severe abuse...obtained in 11 cases"[20]. There are also additional studies showing the corroboration of recovered memories[21][22][23][24].
