Another case in the Indo today, apologies if someone has posted it already, seems a similar sentence

A JUDGE has sentenced a serial burglar to 12 years for a rape during a home invasion but suspended the final three years on condition he completes his Leaving Certificate.

Gerard Kane (36) was on bail at the time for a previous burglary of the constituency office of former Fianna Fail minister, Barry Andrews. He received a two-year sentence last July for the break-in.

Kane threatened to bury the rape victim in the back garden and said he would hang himself if she went to the gardai. During the ordeal he went to the bathroom and returned with “white powder” on his bottom lip before raping the woman again.

As he was leaving, he made her promise not to call gardai, gave her a hug and asked for her number so he could take her out to dinner.

Not that I want to take away from the harrowing treatment the poor victim received from the animal but do you think Bob that children raised in dysfunctional homes won't grow up to be dysfunctional adults?

Kane has spent most of his adult life in prison, with 26 previous convictions for burglaries, robberies, drug possession and assaults.
There are simply no words!

He imposed a 12-year sentence but suspended the final three years on condition that Kane completes two years of study for his Leaving Certificate and then an additional two-year educational course.

Perhaps-I'm uncertain about this-the stipulation that a decreased sentence must follow a guilty plea has no room for discretion and must be followed despite the circumstances. A last-minute and obviously self-serving guilty plea may carry the same weight as an early guilty plea and genuine remorse...unfortunately.
Did he change his plea before the jury decided? If so, then the rule is probably designed to prevent rapists getting off due to some juries making unexpected verdicts (say a 1 juror hold out).

The idea would be that a 100% certainty of a 9 year sentence was better than a 90% chance of a 12 year one.

I never understand the concept that if you pay the victim a large enough sum of money, then you get a reduced sentence. It never stuck me as being very democratic. And yes, in a rape case it a disgusting insult to the victims.
.. and if the victim refuses, then it should have no effect.

By what standards is it hefty?

Irish law based upon old colonial laws, themselves based on Norman feudal Colonial laws >> laws primarily designed to protect assets not people.
A hefty sentence! that would be death, & only inappropriate because the low life would not have to suffer for long.

The attacker is a serial rapist.
If his tattoo claim from Colverhill is true (probably his defense idea) then that is a shame.
They should have tattooed it on his forehead, so women could be well warned of his sick cowardly evil.
As a Hindu?,he will wear the swastika with pride.
