Garda independence, use of resources and management: the Cowen caricature case

The proper deployment of finite Garda resources is a cornerstone of effective Garda management. The independence of the Garda from political direction is an essential feature of our justice system.

Extensive new powers have been given to the Garda to enable them to keep up with the changing technologies used by criminals - so for instance email records must be preserved by ISPs and so on. Use of those powers is, we are assured, carefully monitored and appropriate.

Controversy and public disquiet erupts from time to time where it may appear that insufficient Garda resources are applied to a serious issue - whether that be policing certain parts of Limerick, drug dealing locally, Shannon Airport, or investigating alleged white collar crime in banks.

The unanswered questions around the withdrawal of serious charges against a Louth drug dealer (featured in Prime Time Investigates recently) intensify this public disquiet. In that case a family was terrorised in its home by a masked man who threatened them over reporting drug crime to the Guards - which they had done believing it was 'in confidence'.

Against this background what are the public - whose support the Garda depend on and usually can count on to do their vital work - to make of this?

A garda visited the offices of Today FM yesterday afternoon looking for email contacts the Ray D'Arcy Show show had with the artist who painted the nude portraits of Brian Cowen that were hung in two Dublin galleries.

On his show this morning, D'Arcy said the show’s producer Will Hanafin had spoken with the garda who had told him that “the powers that be want action taken”.

Mr Hanafin said he was told that the Gardaí wanted the name and contact details of the artist so they could caution him and when he declined to pass the information on, he was told a warrant might be sought to get access to the show’s emails.

Is this appropriate use of Garda resources?

Does this undermine public confidence in Garda independence from political interference?

This waste of garda time and resources threatens to turn Cowen into the caricature of himself he objects to.

The Gardai can't just sieze emails willy-nilly.

They can make it out as if you have to comply with their requests (most people do), but you should know the law and never succumb to Garda bullying.

This incident amounts to abuse of power and political interference with the Gardai and DPP. Enough to topple governments in other countries.

This is very dangerous, this is a threat to our democracy.

The Guards are supposed to be independent, we all know well they are not.

Its time to reclaim our republic, and there is only one way to do it...

Well said, we dont have political opposition here, we need to overthrow these fatcat clowns ourselves.

Its the Garda commissioner that should be doing the explaining.

I made complaints to the Guards about ahern and nothing was done.

im glad the OP has spun this out of the other thread as while having some nutter like kennedy demand the resignation of cathal gowan on the back of a "dead donkey" peice and the brow beating of RTE into an "apology" is serious enough this is in a WHOLE other league.

WTF is this doing as a matter for the gardai !!!

how on earth can it be justified when theres documented CRIMES having being admited to in the tribunals and a tax cheat in the dail with NO tax clearance cert willfully being IGNORED by the same police force?

SOMEONE made an offical complaint to the gardai. thats the ONLY way these things get started so who the hell thinks this non issue is worthy of taking valuable gardai resources ,and COURT time FFS if they go to get that warrent, to assuage the EGO of brian cowan

there is NO CASE for indecency here as a cursory examination of the galleries of this town will show FAR more revealing pictures, christ we got BODIES of people shot by the chineese gov on display and no ones gone down for that. in fact THEY made money.

and CRIMINAL DAMAGE ? putting a tack in a wall to display the picture? HOW in the name of god, if that DID manage to get all the way to a conviction, could you EVER prove the artist put the pictures up? he's already come out on the ray darcy show to say he got shot of the pics to a third party !!

and dont start me on incitement to hatred. HOW the ******************** do you get that from those pictures ? cowans done more for that HIMSELF with the pensioners by trying to take the medical card off them !

i swear . this thing started out as a joke that wouldve blown over in a day or two.

NOW we have genuine questions to ask about the state of democracy in this country, the independance of the state media, the ability of the comercial media to broadcast stories, and the impartiality of the gardai with the prospect of them being defacto being used as a goon squad for the governement and their cronies.

FFS the rest of the world must be falling about laughing at us. i wouldnt be surprised if it hits the fecking STOCK MARKET at this stage.

after all would YOU invest in a country ran like this?

this issue has transformed now. its a very very serious issue about our democracy and the constitutional rights of the citizen to free expression.

P.S where the ******************** are the oppostion on this abuse of power?

Listening to Joe Duffy the other day, it seems that Tipperary town is being terrorised by a gang of thugs and the Guards refuse to do anything about it.

So perhaps one of the locals could try and get one of these thugs to punch a photocopy of one of the Cowen paintings. Surely such a heinous crime would force the Guards to act, and end the locals nightmare?

Well go get a Warrant then and do it the right way. I'd imagine that this budding artist's lawyers will be working on a Defence and factoring all of this into it, along with the argument of being unable to have a fair trial etc etc etc - that's if a prosecution attempt proceeds in the first place

And only after Joe carried the Tipp Town story over 2 days did the Guards do anything about it. Yesterday morning the Garda helicopter, armed units, 15 vehicles etc were deployed in Tipp to effect 4 arrests where there was never any suggestion of weapons being involved. If you want the Guards to do their job in this country it seems you have to call Joe.
