There is nothing other that having an interesting in the property, which he might have had, that could of been a valid defence. However according to the paper, one of the orders was only got in January 2018. There were a couple of orders so it depends on which order the company were using to have the property possessed.
Wouldn't disagree but it would be very clear the brother had no interest if registered property involved. The order for possession was obtained in the high court years ago so they would have operated off this. Subsequent orders were probably just execution orders. In any event, these proceedings appear to be a challenge to the actual eviction so when it goes ahead the Court will decide on all aspects of this. I look forward to complete clarity on this one

I'm surprised nobody has commented more on this sixth arrest....the indo has the guards calling it a significant arrest and the person involved being a central figure in the attack. Facebook has named the person arrested too.

A 50-year-old man arrested in connection with an investigation into criminal damage and an assault in Co Roscommon has been released without charge.

He was arrested yesterday and detained at Castlerea Garda station under Section 30 of the Offences Against the State Act, 1939.

A file will be prepared for the Director of Public Prosecutions.

7th man arrested


A 50-year-old man arrested in connection with an investigation into criminal damage and an assault in Co Roscommon has been released without charge.

He was arrested yesterday and detained at Castlerea Garda station under Section 30 of the Offences Against the State Act, 1939.

A file will be prepared for the Director of Public Prosecutions.

Six people arrested , so that is as least twice as many as Bankers arrested in the history of the state. Obviously we know which grouping has caused the most suffering for the Irish population .

The story rumbles on and on... The "journalist" in question was interviewed by none other than gemma o Doherty on her YouTube channel in December and spilled his guts as to what the gardai were questioning him on. The video that he put up on the Democrat Newspaper website showed the immediate aftermath of the attack at the farmhouse. In fact, you see a person in the video, either an attacker or victim. Whoever filmed the video was at the farmhouse very very quickly after the attack or were present at it...

The Gardai are in possession of the phone and have promised not to interfere with it which should be very assuring for the journalist. Is it possible his phone could ‘go missing’ which seems to be a major problem with items in GS possession. We see the length they go to in order to access other’s mobile devices, just a pity they couldn’t provide access to their own devices when required at disclosures tribunal.

Meanwhile one of the McGanns has sought court orders against the bank.
Is that family still on the property? I would have thought that their legal status regarding their presence on the property wouldn't have been any better than that of burglars really, at this stage?

Seems that they moved in the day after the attack and have remained since. They released a statement saying that condemn violence but are happy enough to take advantage of that violence and move back into the property.

I don't imagine that the borrower, Mr McGann has suddenly started paying the mortgage since the December incident.

Interesting they have named all 3 + others unknown, was it not stated at the time that the origional eviction notice had only 1 name

The court case in which the bank got the order for possession had only one defendant but the order for possession is not an order directed at named individuals. It's an order directed against the property so it does not matter who is named on it or not.

The 3 people plus others unknown being named as defendants is because an injunction is an order directed to named people to do a particular thing (or refrain from doing a particular thing).
