Report suppressed: High Court Judge warned Government last August on risk of issuing its own booklet

The Independent claims that the Government is sitting on a critical report from the Chair of the Fiscal Treaty RefCom about publishing its own materials in parallel to the Commission.

'The Government was warned by High Court judge Kevin Feeney that its controversial information booklets – delivered along with the independent referendum watchdog's literature – had caused confusion among voters during the previous referendum, on the EU Fiscal Treaty.

In its report on that vote held last May, the Referendum Commission, headed by Mr Justice Feeney, said its research after the event found the dual campaigns caused problems.

The critical comments on the Government's information campaign are contained in the conclusions of the report provided to the Department of the Environment in August. But the report has yet to be released.'

Government ignored judge's warning ... - National News - Independent.ie

The headine contains an error because the story is about the Fiscal Treaty booklet and related material issued at public expense by the Government rather than the latest referendum.

There was no legal action on that occasion. Perhaps the Government thought they were out the gap for good.

The govt must cease confusing voters with partisan and biased misinformation-booklets. One can only conclude that with their two-thirds majority the power is going to their heads.

Running a fair referendum is easy.

Yet successive governments manage to avoid doing that, time after time.

Better luck next time?

So why have they not published Judge Feeney's report?

The "independent" RefCom also have a case to answer for their booklet for that particular referendum. They used tried and tested advertising techniques within the booklet to advertise a Yes. They used a PR company used by FG which hardly instills confidence with regard to impartiality.

With the current one, the "Stability" treaty and the re-running of referenda when the Government of the day don't get the result they want.... the whole idea of a public vote to change the Constitution is becoming a travesty.

Imagine if we had a government that suppressed a report from a High Court judge, about its conduct in relation to a Constitutional matter.

Imagine that government continued to act in defiance of the Judge's warning.

Imagine that all came out in the wash - and nobody blinked.

Nah, impossible.

The current campaign continued with the "Vote Yes or No" slogan. It was never "Vote No or Yes".

I would be very surprised if it wasn't the same consortium that was used for the "stability" treaty. I think it was two or three companies that included an ad agency and a PR firm. Why is an ad agency needed to put together a neutral referendum document? Ad agencies sell the message they are hired to sell.... pure and simple.

The current fracas may spark off something in relation to the "stability" referendum, and events surrounding it.

This is interesting from Micheál Martin:

Mr Martin said the Government had clearly been annoyed with the commission’s information campaign during last year’s referendum to give the Oireachtas more power for inquiries, which was rejected.

This, he claimed, had prompted the Government to run a parallel campaign in the children’s rights referendum and in the European fiscal treaty vote, which was held in May.

“The Government needs to explain the sequence of events as to who made the decision to do the parallel campaign, which is essentially politicising the information,” Mr Martin added.
AG 'scapegoated' over referendum

That theory fits the known facts. But is it right?

Looks like a case of the judges getting even with government over their cut in pay.

And before ye attack me and say Judges are all perfect , remember some of them have been before the courts in recent times , they are only human beins, some of them not even living in the real world

It looks nothing like that at all.

Why has the Fiscal Treaty Referendum Commission Chairman's Report not been published, even though later reports on the subsequent Referendums on Judges' Pay and on Inquiries have been?
