The legality of this does look suspect I must admit. Under the Vacancies Act 1998, someone appointed to fill a vacancy must have been previously confirmed to a job by the Senate (not necessarily the same job). Apparently Whitaker has not been.
Once again the orange moron shows he doesnt know the law or that he doesnt give a fook about the law

On the contrary, it may be that he's been very well advised indeed about the law. It all depends on whether, once he's got Whitaker in as "acting" AG, can he refuse indefinitely to nominate a replacement. And does the "acting" attorney General possess the same powers to act as the real live one? Can he starve the Mueller investigation of funds, for example?

I don't think it necessarily is unlawful. The Vacancies Act allows a vacancy to be filled by someone who's been confirmed by the Senate or the 'first assistant' of the office being filled. As Sessions' chief of staff, I think Whitaker probably fits into that category.

I fear you may be right. Trump is an idiot, but not all his advisors are totally brainless.

Will be much easier to confirm Sessions' eventual full time replacement with 53 or 54 Senate seats.

You mean that when firing Jeff Sessions for recusing himself from the Russia investigation, it never occurred to them when hiring his replacement (not the Deputy AG) to ask him about his easily verifiable, published views on the Russia investigation?

Sounds legit.

Turns out there is an active FBI investigation into a company of which Whitaker is a board member, as AG Whitaker would oversee the beurea..where does the morron find these guys?
