The developer Seán Dunne filed for bankruptcy last Friday night. In his application he said he has assets of between a million and ten million dollars, but that he owes between €500m and a billion. Nama has been pursuing him in the civil courts over a debt of more than €150million.
The US bankruptcy process is faster than in Ireland. Debtors there can expect a discharge of their debts within one year or so. Seán Dunne said he hopes to be debt-free within six months.
Nama notified the US Bankruptcy Court that they are a creditor of the bust developer. In the first indication that Dunne's attempt to be cleared of his debts within months will be contested, the trustee in the case has told the court that he intends to take over the Nama claim "if it appears to have merit". Nama began pursuing Seán Dunne and his wife Gayle Killilea in the Connecticut Superior Court after it secured a €185m judgment against him in 2012. Nama’s lawyers pointed out to the Court that the agency is "a creditor and party-in-interest" in the bankruptcy proceedings and have asked that all notices and filings in the case be forwarded to them.
